Debt Collection Lawsuits
Debt collection lawsuits occur when creditors or debt buyers sue consumers to recover unpaid debts. It’s essential to respond promptly to avoid default judgments that can lead to wage garnishments or asset seizures. Our office specializes in defending individuals who have been sued for debt in the following areas:
- Authorized User Defense: If you are being sued for a credit card debt but were only an authorized user and never agreed to be responsible for the charges, you may not be held liable.
- No Cosigner Notice Defense: If you cosigned a loan for someone else and did not directly benefit from the loan or were not given proper notice, you can raise this defense.
- Payment Disputes: If you have already made payments but the creditor has not credited them correctly.
- Identity Theft or Mistaken Identity: If the debt is not yours due to identity theft or mistaken identity then you have a defense.
- Foreign Language Defense: In California, if a contract was negotiated primarily in a non-English language such as Spanish, Chinese, Tagalog, Vietnamese, or Korean, the business must provide a fully completed copy of the contract in that language. Failure to do so renders the agreement unenforceable. This defense is especially strong in cases involving vehicle purchases or loans, but the burden of proof falls on the consumer to show the negotiation was conducted in a covered language.
